In a divorce or relationship break-up, it can be the children who suffer more than anyone. The life they have known is changed forever, there is often upheaval at home and it can have a lasting effect on them.
This involves minimising the impact upon the child’s daily lives where possible, ensuring they are provided for financially and making sure they continue to benefit from being with both parents wherever possible.
The law is very clearly based upon the rights of the children, rather than those of the parents.
In most instances absent parents – most commonly fathers – have the right to regularly see their children.
Everything becomes incredible if this law, instead of helping the children delivers them into of hands a dad pedophile.
It’s an Incredible ruling, a court has ordered two baby girls to spend weekends with their sex offender father provided he puts a door on their bedroom they can lock.
Judge Robert Benjamin, in the Family Court’s Hobart branch, ruled that the girls "need some protection from (their father), particularly at night".
However, the risk of sexual abuse was "diminished when they are awake and alert".
Judge Benjamin said that the father, who was convicted of downloading child pornography, must have an "adult friend" stay with him when the girls stayed overnight.
He added that until the youngest turned 14, the girls must "share the same room so they can have the mutual support of one another".
The case has outraged women’s groups, who say it puts the girls at risk to satisfy the father’s desire to see them. It’s an incredible ruling …

Fino all’età di quattordici anni le bambine devono condividere la stessa stanza in modo da poter avere il sostegno reciproco".
Un consigliere del Tribunale della Famiglia ha detto che le bambine di otto e dieci anni, quando sono insieme, sveglie e vestite, hanno l’età e la maturità per rendere improbabile un’azione impropria del padre nei loro confronti. Tuttavia, di notte, quando dormono sarebbero meno sicure".
Il caso ha indignato molti gruppi di donne, hanno detto che il Tribunale per soddisfare il desiderio del padre di vedere le figlie ha messo le bambine a rischio. Lo stesso Tribunale ha accertato che l’uomo aveva invitato una delle due bambine nel suo letto e che: "Aveva dimostrato affetto verso di lei in una maniera che era, in tutte le circostanze, impropria per una bambina di quell’età". La bambina più grande ha detto ai giudici che aveva paura di passare la notte con il padre.
L’uomo è stato condannato nel 2007 per tre reati di pornografia infantile: ha scaricato nel suo computer immagini di pornografia infantile, ha creato link e collegamenti a siti di pornografia infantile.
Un giudice in Tasmania non convinto dalla sentenza favorevole al pedofilo, ritenuto non a rischio per i bambini, ha inserito il suo nome nel registro dell’elenco dei pedofili.
La moglie ha lasciato il marito pedofilo, ora sta combattendo per limitare i contatti con le due figlie. I suoi sforzi, sono stati vanificati da questa sconcertante sentenza del Tribunale.
